General Terms and Conditions for the online delivery (download) of scientific publications to private individuals, companies, and institutions (last revised April 19, 2021)
§ 1 Preamble

The Shaker Verlag GmbH – 52353 Düren
- hereinafter referred to as "publisher" -

offers readers of scientific content
- hereinafter referred to as the "purchaser" –

offers the opportunity to purchase academic publications, particularly research reports, postdoctoral theses, dissertations, diploma, bachelor's, and master's theses, outstanding student research papers and seminar papers, as well as other theses, studies, or other papers for a fee. This service is aimed at private individuals, companies, and institutions.

The following General Terms and Conditions apply exclusively to contracts for the delivery of scientific publications to companies, institutions, and private individuals.

§ 2 Order; conclusion of contract; production; delivery

The publisher accepts orders by activating the download function (online ordering) on ​​the website www.shaker.de or www.shaker.eu.

Delivery is via data transfer (download) in a file format specified on the website (online catalog), or in exceptional cases, by mail on a CD-ROM. The ordered files may contain protection to prevent duplication, printing on paper, or forwarding to third parties. The purchaser must inform themselves about this in advance on the publisher's website or online catalog.

A contract is concluded when the purchaser uses the publisher's download function, initiates an online payment by submitting their credit card details or initiating an online payment (PayPal), and in return, the publisher transfers the ordered content either online or by mail.

§ 3 Sales prices; payment arrangements

To download a publication, the purchaser pays the catalog price of the publication by entering their credit card details in the provided prompt or by activating an online payment method (PayPal). Shipping costs are not charged. The prices for the scientific publications offered are based on the respective prices listed in the online catalog on the publisher's website www.shaker.de or www.shaker.eu. The purchaser pays the publisher a fee for each scientific publication equal to the corresponding catalog price, including VAT. The purchaser will receive confirmation of delivery, payment, and an invoice by email. A separate paper invoice will not be sent.

§ 4 Reservation of title

Until all outstanding amounts due from the purchaser have been paid in full, the delivered goods remain the property of the publisher in accordance with Section 3 of these Terms and Conditions.

§ 5 Rights of use and utilisation

All copyright exploitation rights to the respective scientific publication remain with the publisher or its authors. The purchaser is not authorized to reproduce, distribute, or publicly display a publication.

§ 6 Warranty; complaints

The warranty period for goods delivered by the publisher is 24 months from receipt of the goods. This does not apply to defects that were fraudulently concealed from the publisher. If the purchaser receives a visibly damaged or incomplete file, they must notify the publisher within 8 days of receipt in writing, by email, or by phone at +49 2421 990110. In the case of incomplete scientific publications, the publisher will immediately provide subsequent performance. If subsequent performance fails, is unreasonable for the purchaser, or if the publisher refuses subsequent performance, the purchaser is entitled, at their discretion, to withdraw from the contract or to reduce the purchase price.

Complaints regarding content-related deficiencies in publications are excluded. The publisher assumes no responsibility for the quality of the content and design of individual documents, in particular the presentation, structure, and functionality of the procedures described therein, as well as the accuracy of the data and results obtained. The authors themselves are responsible for the content of the publications. The publisher does not guarantee that the publications have been prepared, evaluated, and published in accordance with legal requirements, in particular examination regulations.

§ 7 Liability

The publisher is not liable for damages that do not occur to the delivered goods themselves, in particular not for lost profits or other financial losses suffered by the purchaser, unless they are based on gross negligence or willful misconduct on the part of the publisher.

§ 8 Access to the contract text

The purchaser can view the general terms and conditions at any time on the website www.shaker.de or www.shaker.eu. For security reasons, the purchaser's specific order data is not accessible online and will be treated confidentially in accordance with our privacy policy.

§ 9 Data protection

The purchaser agrees to the storage of his or her personal data. The stored data will only be collected, processed, and used to the extent necessary for the establishment, execution, or modification of the contract.

The publisher has informed the purchaser in detail about the scope and purpose of the collection, processing, and use of his data required to execute the order. The purchaser expressly consents to the collection, processing, and use of his data, to the extent that his consent is required in individual cases.

§ 10 Closing provisions

All disputes arising from this contractual relationship shall be governed exclusively by German law. The exclusive place of jurisdiction shall be the publisher's registered office.
